Consent with the processing of personal data
We are aware that our customers, visitors, users and others who visit our website (collectively referred to as “Users”) appreciate their privacy. This document therefore contains important information regarding the rules that we follow when processing personal data.
All processing of personal data by us always takes place in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”).

The Provider has not appointed a person responsible for the protection of personal data because the Provider is not in a liable person in line with Article 37 GDPR.
The transfer of personal data to a third country or international organisation:
The Provider does not transfer personal data to third countries or to international organizations within the meaning of Article 44 et seq. of GDPR.
Automated individual decision-making and profiling:
The Provider does not perform profiling or automated individual decision making.
Supervisory Authority:
The Supervisory Authority at the Provider’s location is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), registered seat at Pplk. Sochora 27, 170 00 Prague 7, e-mail: , phone: 234 665 125.
Provider’s Position:
The Provider acts both as a Personal Data Controller and as a Personal Data Processor.
PROVIDER ACTING AS THE PERSONAL DATA CONTROLLER
The Provider acts as the Personal Data Controller in relation to the personal data of the following persons: clients.
What personal data is processed by the Provider for what purpose and on what legal basis?
Website visit. The Provider processes the data obtained from natural persons when such natural persons visit the Provider’s website. When visiting the website, the Provider collects and processes the following types of personal data, which are stored: IP address. Furthermore, the Provider processes the following data: browser type and language, server requirements, including time data and the referencing URL. These data are necessary to correctly display the website. In addition, they may also be used as necessary to maintain safe operation of the website and other purposes described in this Personal Data Protection Policy. The Provider processes these personal data on the basis of its legitimate interest or consent of the User. The Cookies Information is Listed Below.
For the purpose of performance of the contract (in particular conclusion of a contract, communication with the customer), implementation of measures taken before conclusion of the contract (pre-contractual negotiations) or performance of legal obligations (in particular bookkeeping, issuing and recording of tax documents), the Provider processes the following personal data: name, surname, date, residence, telephone number, e-mail.
The Provider obtains Personal Data directly from the User when concluding a contract, therefore it always informs which of the Personal Data it has to provide for the purpose of performance of the contract.
The principle of data minimisation is respected by the fact that only information that the Provider necessarily needs to enter into a contract or to fulfil its contractual obligations or to handle which the Provider has a legal obligation is required. The provision of other Personal Data is on a voluntary basis.
Should the Provider intend to process other personal data than specified in this article, or possibly for other purposes, the Provider may only do so based on a valid consent allowing processing of the relevant Personal Data. The consent to process the Personal Data is to be provided by on a separate document.
Information on the processing of Personal Data of the Provider’s employees is provided in a separate internal regulation.
Sensitive Personal Data
The Provider, as the Personal Data Controller does not process the User’s Personal Data belonging to special categories of personal data pursuant to Article 9 of the GDPR.
For how long will the Provider process your Personal Data?
Personal Data shall only be processed for as long as there is a legal reason for the storage of the same, and then the data shall be deleted without delay.
Personal data processed in order to comply with the obligations arising from special legal regulations shall be processed by the Provider for a period determined by the relevant legal regulations. These include, for example, legal storage of data or documentation obligations. These include, in particular, obligations relating to the storage of data arising from civil, commercial or tax legislation. If the obligation to keep the data ceases, the Personal Data shall be deleted without delay.
Other Personal Data are processed for: Personal Data are processed for the duration of the contractual relationship with the customer and subsequently for a period of 1 year from the end of the contractual relationship.
THE PROVIDER ACTING AS THE PERSONAL DATA PROCESSOR
The Provider acts as a Personal Data Processor for other controllers.
The Controller of such Personal Data is obligated to comply with all personal data protection rules set by the GDPR and other legal regulations governing this issue. The Provider shall not be liable for any breach of the Personal Data Protection rules by the Controller of such personal data.
What Personal Data are processed by the Provider as the Personal Data Processor and what is the purpose of the processing?
The Processor processes the following Personal Data: IP address, name, surname, e-mail address.
The purpose of the processing is: the processing of data for the purposes of the Controller’s use.
If the Provider becomes Processor of Personal Data belonging to special categories of data, the User is responsible for the lawfulness of obtaining and handling such data according to the GDPR as well as national legislation. The Provider reserves the right to remove such Personal Data from its servers in case of non-compliance with the conditions for processing of Personal Data of special categories. Before removing the Personal Data, the Provider shall contact the User with a request for correction.
For how long does the Processor process the personal data?
The Provider processes the personal data for the duration of the contractual relationship with the User. After the termination of the contractual relationship, all data shall be deleted without undue delay after the termination of the contractual relationship. Users are entitled to request deletion of data at any time during the duration of the contractual relationship. If the User receives a request to delete the data, the Provider shall delete all data without undue delay.

Personal data may also be transferred for processing to the Cookie Providers specified below in this Personal Data Protection Policy.
Personal Data may only be processed by the Processors based on general data protection regulation contract providing guarantees in terms of organizational and technical data protection issues and specifying the purpose of the processing whereas Processors cannot use the data for other purposes.
Personal Data may, under certain conditions, be made available to government authorities (courts, police, public notaries, tax authorities, etc., to the extent of the exercise of their legal powers) or may be provided to other entities within the scope defined by a special law.
METHODS OF DATA SECURITY
In order to secure the User’s data against unauthorised or accidental disclosure, the Provider shall use adequate and appropriate technical and organisational measures.
If servers are located in a data centre operated by a third party, the Provider shall ensure that similar technical and organisational measures are implemented with this third party.
All data is located only on servers located in the European Union or in countries, ensuring the protection of Personal Data in a manner equivalent to the protection provided by the legislation of the Czech Republic.
The Provider uses the following data security procedures: Software data security procedures, mechanical data security procedures, adoption of GDPR principles.
USERS’ RIGHTS
Each user has:
- the right of access to personal data: The User has the right to obtain from the Provider a confirmation whether the personal data related to him / her are processed or not processed, and if so processed, the User has the right to access the personal data including the following information: a) the purpose of the processing; b) categories of personal data concerned; c) recipients to whom personal data have been or will be made available; d) scheduled time for which personal data will be stored; e) the right to request Controller to correct or delete personal data or to limit personal data processing or to object against processing; f) the right to submit a complaint at the Supervisory authority; g) the right to access all available information related to the source of personal data, unless data have been obtained from the Users; h) whether automated decision-making is taking place, including profiling. The User also has the right to obtain a copy of the processed Personal Data.
- the right to correct personal data: The User has the right to request the Provider to correct inaccurate personal data related to the User, without undue delay, or to supplement incomplete personal data.
- the right to erasure of personal data: The User has the right to request the Provider to delete personal data related to the User a subject immediately and in the following cases: a) personal data are no longer needed for the purpose for which they were collected or processed; b) the User withdraws the consent based on which data were processed and there is no legal reason for data processing; c) the User submits an objection against data processing and there are no significant legal reasons to continue with the processing; d) personal data were processed illegally; e) personal data must be deleted upon the fulfilment of legal obligations specified in the EU legislation or the legislation of a member state; f) personal data were collected based on a service offer provided by an information company. Hover, the right for data deletion shall not apply if processing is necessary for the fulfilment of legal obligations or to determine, exercise or defend legal claims as well as in other cases specified in the GDPR.
- right to limit processing: The User has the right to request the Provider to restrict data processing in any of the following cases: a) the User denies the accuracy of Personal Data and such restrictions shall last for the necessary time allowing Provider to verify the accuracy of Personal Data; b) processing is illegal and the User rejects deletion of Personal Data but demands data use restriction instead; c) the Provider does not need data for processing purposes but the User needs the data to define, exercise or defend legal claims; d) the User submitted objection against processing until it is verified that legitimate reasons of the Provider outweigh legitimate reasons of the Data Subject.
- right to object to processing: Based on a particular situation and reasons of the User, the User is entitled to submit objection against processing of Personal Data related to the User any time, and which are processed based on a legitimate interest. In such case, the Provider stops processing the Personal Data until it proves serious justified reasons for the processing exceeding the interests or the rights and freedoms of the Users, or for the determination, performance or defence of legal claims.
- right to data transferability: The User has the right to obtain Personal Data, related to the User and provided to the Provider, in a structured and commonly used machine-readable format and forward such Data to another controller if: a) the processing is based on a consent and b) the processing is done automatically. While exercising your right to data transferability, the User has the right that the personal data are transferred directly by one Controller to another Controller if this is technically feasible.
- right to file a complaint with the supervisory authority: If the User believes that the Provider does not process the User’s Personal Data lawfully, the User has the right to file a complaint with the supervisory authority. The contact details of the supervisory authority are shown above.
- information regarding correction or deletion of personal data or processing restrictions: The Provider shall inform the individual recipients who have been provided with access to personal data of any correction or deletion of the personal data or their processing restriction, which shall not apply if it turns out to be impossible or if it requires inadequate efforts. If requested by the User, the Provider shall inform the User about these recipients.
- right to be informed when personal data protection has been violated: If a certain data security breach scenario is likely to result in a high risk for the rights and freedoms of natural persons, the Provider is obligated to report such breach to the User without undue delay.
- right to withdraw consent to personal data processing: Should the processing of any personal data be based on a consent, the User has the right to withdraw the consent with the personal data processing in written form and at any time by emailing a consent withdrawal note to: .
COOKIES
The Provider uses cookies, which are small text files that identify users of the Provider’s website and upload its user activities.
Text in cookies usually represents a line of numbers and letters which clearly identify the computer of the User, but do not provide any particular information about the User. A cookie typically contains the domain name from which it was sent, age information and alphanumeric identifier.
The Provider’s website automatically identifies the IP address of the User. All this information is recorded in the file where the server activity is stored and which allows further information processing. The Provider further records the request from the browser and the time of the request, the status and the amount of data transferred within this request. It also collects information on the browser used and the computer’s operating system and its versions. It also records the websites from which you have reached the Provider’s website. The IP address of your computer is stored only for as long as the website has been used and for the necessary time. Upon expiration, the IP address is deleted or anonymized by shortening.
TYPES OF COOKIES AND SIMILAR TECHNOLOGIES
Technical cookies and similar technologies: Due to its legitimate interest, the Provider uses technically necessary cookies that are necessary for the operation of the website and for ensuring its functionality. These may be permanent or one-off cookies. The permanent cookies remain on the hard drive even after the browser is closed. Permanent cookies may be used by the browser during further visits to the Provider’s website. Permanent cookies may be removed. One-off cookies are temporary and are deleted when the browser is closed. The Provider uses these data to operate the website, in particular to identify and resolve errors, to determine the use of the website and to make modifications or improvements. This concerns the purposes for which the Provider has a legitimate interest in data processing pursuant to Article 6 (1) (f) of the GDPR.
The User may set his/her browser to block such cookies. The Provider points out that in such a case certain parts of the website will not work.

Analytical cookies and similar technologies: These cookies help the Provider analyse how the Users use the website. They can be used, for example, to measure and improve the performance of websites. These cookies enable, for example, to find out how the User came to the website, whether directly, via a search engine or via a link to the social network. Further, the Provider learns how long the Users stay on the page and what links they click on.

To obtain and manage the User’s consent, the Provider uses the CookiesLišta.cz platform by Soft Evolution s.r.o., Company ID No.: 46982230, Martinice 100, 594 01 Velké Meziříčí. The platform collects device information, browser information, anonymized IP address, visit date and time, URL request, web path and geographical location. This allows the User to be informed about the Provider’s web environment and to obtain, manage and document the Provider’s consent. The legal basis for data processing is Article 6 (1) (c) of the GDPR, as the Provider is legally obligated to provide proof of consent in accordance with Article 7 (1) of the GDPR. Data will be deleted as soon as they are no longer needed for logging and there will be no legal retention requirements.
